Privacy Policy

Medlock Electrical Distributors Limited, a private limited company registered in England and Wales with its registered office at 109-115 Eleanor Cross Road, Waltham Cross, Hertfordshire, EN8 7NT (references to “we” “our” and “us” to be construed accordingly) are committed to protecting and respecting your privacy.

This privacy policy (together with our terms of use and any other documents referred to on it) sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us.  Please read the following to understand our practices regarding your personal data and how we will treat it.

1.            Information we may collect from you

1.1          We may collect and process the following data about you:

1.1.1.           information that you provide by filling in forms on our websites: www.electricpoint.com and www.electricpoint.co.uk (referred to together and individually as our “Websites”) such as but not limited to your name, address, bank account details for payments. This includes information provided at the time of registering to use our Websites, subscribing to our services, posting material or requesting further services. We may also ask you for information when you enter a competition or promotion sponsored by us, and when you report a problem with our Websites;

1.1.2.           if you contact us, we may keep a record of that correspondence;

1.1.3.           we may also ask you to complete surveys that we use for research purposes, although you do not have to respond to them;

1.1.4.           details of transactions you carry out through our Websites and of the fulfilment of your orders;

1.1.5.           details of your visits to our Websites including, but not limited to, traffic data, location data, weblogs and other communication data, whether this is required for our own billing purposes or otherwise and the resources that you access; and

1.1.6.           we may receive information about you from other sources (such as credit reference agencies) which we may add to the information we already hold about you in order to provide a more personalised service tailored to you.


2.1          We many use your data for the following purposes:

2.1.1.           to help us identify you and any accounts you hold with us;

2.1.2.           administration;

2.1.3.           statistical analysis;

2.1.4.           marketing;

2.1.5.           fraud prevention;

2.1.6.           billing and order fulfilment and to fulfil other contractual and legal obligations between you and us;

2.1.7.           credit scoring and credit checking (please see below);

2.1.8.           customising the Websites to your preferences;

2.1.9.           to notify you of changes to the Websites, this privacy policy, the terms and conditions of sale, the terms and conditions of use or our goods/services which may affect you;

3.            CREDIT CHECKING

To enable us to make credit decisions about you and for fraud prevention and money laundering purposes, we may search the files of credit reference and fraud prevention agencies (who will record the search). We may disclose information about how you conduct your account to such agencies and your information may be linked to records relating to other people living at the same address with whom you are financially linked. Other credit grantors may use this information to make credit decisions about you and the people with whom you are financially associated, as well as for fraud prevention, debtor tracing and money laundering purposes. If you provide false or inaccurate information and we suspect fraud, we may record this.

4.            Information about other individuals

4.1          If you give us information on behalf of someone else, you hereby confirm that the other person has appointed you to act on his/her behalf and has agreed that you can:

4.1.1.           give consent on his/her behalf to the processing of his or her personal data;

4.1.2.           receive on his/her behalf any data protection notices; and

4.1.3.           give consent to the transfer of his/her personal data abroad.

5.            IP addresses & COOKIES

5.1          We may collect information about your computer, including where available your IP address, operating system and browser type, for system administration and to report aggregate information to our advertisers. This is statistical data about our users' browsing actions and patterns, and does not identify any individual.

5.2          For the same reason, we may obtain information about your general internet usage by using a cookie file which is stored on your browser or the hard drive of your computer. Cookies contain information that is transferred to your computer's hard drive. They help us to improve our Websites and to deliver a better and more personalised service. Some of the cookies we use are essential for the Websites to operate.

On 26 May 2011, the rules about cookies on websites changed. These Websites use session based cookies.  You may delete and block all cookies from the Websites, but parts of the Websites may not work. 6.            Where we store your personal data

6.1          The data that we collect from you may be transferred to, and stored at, a destination outside the European Economic Area ("EEA"). It may also be processed by staff operating outside the EEA who work for us or for one of our suppliers. Such staff maybe engaged in, among other things, the fulfilment of your order, the processing of your payment details and the provision of support services. By submitting your personal data, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy policy.

6.2          Where we have given you (or where you have chosen) a password which enables you to access certain parts of our Websites, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

6.3          The transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our Websites; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

7.            Disclosure of your information

7.1          We may disclose your personal information to any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries, as defined in section 1159 of the UK Companies Act 2006 and a company shall be treated, for the purposes only of the membership requirement contained in subsections 1159(1)(b) and (c), as a member of another company even if its shares in that other company are registered in the name of (a) another person (or its nominee), whether by way of security or in connection with the taking of security, or (b) its nominee.

7.2          We may disclose your personal information to third parties:

7.2.1.           In the event that we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets.

7.2.2.           If we or substantially all of our assets are acquired by a third party, in which case personal data held by us about our customers will be one of the transferred assets.

7.2.3.           If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our terms of use or terms and conditions of supply and other agreements; or to protect our rights, property, or safety, our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.

8.            Your rights

8.1          You have the right to ask us not to process your personal data for marketing purposes. We will usually inform you (before collecting your data) if we intend to use your data for such purposes or if we intend to disclose your information to any third party for such purposes. 8.2          Our Websites may, from time to time, contain links to and from the websites of our partner networks, advertisers and affiliates.  If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies.  Please check these policies before you submit any personal data to these websites.

9.            Access to information

9.1          The Act gives you the right to access information held about you. Your right of access can be exercised in accordance with the Act. Any access request may be subject to a fee of £10 to meet our costs in providing you with details of the information we hold about you.  If you wish to exercise this right you should:

9.1.1.           write to us at our registered office;

9.1.2.           include proof of your identity (for example, a copy of your passport, drivers licence and a utilities bill no more than 3 months old);

9.1.3.           set out the data which you want to access; and

9.1.4.           include any reference (if applicable).
